United States Department of Transportation’s CFR 49 Part 40 and the Federal Motor Carrier’s FMCSA Part 395 Outline Specific Reasons That Drug and Alchol Testing Must Be Carried Out.
Pre-Employment
FMCSA 382.301(a) states that "Prior to the first time a driver performs safety-sensitive functions for an employer, the driver shall undergo testing for controlled substances as a condition prior to be used."
Random
Required under FMCSA 382.305, Every driver (including owner/operators) shall submit to random alcohol and controlled substance testing.
Post-Addident
Required within 8 hours for drugs but no later than 32 hours and within 2 hours for alcohol but no later than 8 hours.
Reasonable Suspicion
Involves sending an employee for testing who exhibits the signs and symptons of drug or alcohol use on the jobsite. Based on the observations of a trained supervisor.
Return to Duty
If a Safety Sensitive Employee Fails a DOT Drug Test, They Must Successfully Complete A DOT Arrpoved Substance Abuse Program (SAP). They Must Then Pass a "Return to Duty" Test Before Resuming Safety Sensitive Duties.
FOLLOW-UP
After a Safety Sensitive Employee Passes a "Return to Duty" Drug Test, They Must Complete of 6 Follow-Up Tests Within 12 Months. The SAP May Continue the Follow-Up Testing Schedule For Up to 5 Years.
